Your Options When You’re Under Contract for a Flood-Damaged Home
When you are under contract to buy a home that has sustained flood damage from a major storm like Hurricane Harvey, the answers to the following questions can help you determine your options:
- Have you already closed on the contract? – If you have not yet “closed” on your purchase contract, you should not be responsible for damage caused by a storm. The seller is required to deliver the property to you in the same condition it was in on the contracting date.
- How much damage occurred? – If the house or property is completely destroyed by a storm before closing, either the buyer or seller should be able to void the contract. The same is true with a residential lease, and the landlord cannot assign your lease to a different property/unit without your consent.
- Is the seller willing to pay for the damage repairs? – If the damage is more minor and repairable, then you may be able to rest easy knowing the seller will have to make repairs before the purchase is final.
